These Terms of Service (“Terms”) apply to your use of marblebros.com and to any purchase you make from Marble Bros Tile and Stone (“Marble Bros,” “we,” “us”). By using our website or placing an order, you agree to these Terms, our Refund Policy, our Shipping Policy, and our Privacy Policy.

1. Orders

All orders are subject to acceptance and product availability. We may refuse or cancel any order, including orders that appear fraudulent, orders with pricing or listing errors, or orders we can't fulfill. If we cancel an order after you've paid, we'll refund you in full.

2. Prices and payment

Prices are in U.S. dollars and may change without notice. We work hard to list accurate prices and product information, but mistakes happen. If an item is listed at an incorrect price, we may cancel the order or contact you before shipping. Sales tax is charged where required by law and is shown at checkout. Payment is due in full when you place your order.

3. Natural stone and product appearance

Marble, travertine, onyx, limestone, and other natural stones are products of nature. Color, veining, pattern, texture, and markings vary from piece to piece and lot to lot, and natural features such as pits, fissures, and filled areas are normal characteristics, not defects. Photos, screen colors, and samples are representative only, and your material may not match them exactly. Ceramic, porcelain, and glass tile can also vary between production runs. We strongly recommend ordering samples, and ordering all material for a project at once, plus 10–15% overage, so it comes from the same lot.

4. Inspection and installation

You're responsible for inspecting all material before it's installed, and for confirming that the product is suitable for your intended use (for example, floors, wet areas, outdoors, or freeze-thaw climates). Installation of material means you've accepted it. Proper installation, sealing, and maintenance are the responsibility of you and your installer. Please follow industry standards and the manufacturer's recommendations. We aren't responsible for labor, installation, removal, or reinstallation costs.

5. Shipping, risk of loss, and returns

Shipping, delivery, and damage claims are covered by our Shipping Policy. Returns, refunds, and cancellations are covered by our Refund Policy. Risk of loss passes to you on delivery to the carrier's delivery address, or when you pick up your order.

6. Website content

All content on this website, including text, photos, graphics, and logos, belongs to Marble Bros or its suppliers and may not be copied or used without our written permission. Product descriptions, specifications, and installation guidance are for general information only and aren't a substitute for professional advice.

7. Accounts

If you create an account, you're responsible for keeping your login secure and for activity under your account. Please give us accurate, current information.

8. Acceptable use

You agree not to misuse the website, including by attempting to interfere with its operation, accessing it by automated means without permission, or using it for any unlawful purpose.

9. Disclaimer of warranties

Except as stated in these Terms or required by law, our website and products are provided “as is.” Any warranty offered by a product's manufacturer is passed on to you, and we don't add any warranty of our own beyond what the law requires.

10. Limitation of liability

To the fullest extent allowed by law, Marble Bros won't be liable for any indirect, incidental, special, or consequential damages, including installation or labor costs, project delays, or lost profits. Our total liability for any claim related to an order won't exceed the amount you paid for the product involved.

11. Governing law

These Terms are governed by the laws of the State of California. Any dispute will be handled in the state or federal courts located in Los Angeles County, California, unless the law requires otherwise.
